Booking Policy

1. Purpose

This policy outlines the procedures and guidelines for booking artists, performers, or entertainers (collectively referred to as "Talent") for events, venues, or productions. It aims to ensure a clear, efficient, and professional booking process for all parties involved.

2. Definitions
  • Talent: Any individual or group engaged to provide entertainment services, including but not limited to musicians, comedians, actors, dancers, speakers, etc.
  • Booker: The individual or entity responsible for securing Talent for an event.
  • Client: The individual or entity contracting the Talent or using a Booker to secure Talent.
  • Invoice: A legally binding agreement between the Talent (or their representative) and the Client (or their representative) outlining the terms of the engagement, operates as a contract between client or booker and talent completing the booking.
  • Force Majeure: The invoice may include provisions for cancellations due to "force majeure" events beyond either party's control.
3. Booking Procedure
  • Inquiry: The Client submits a booking inquiry to the Booker, providing details about the event, desired Talent, date(s), budget, and other relevant information
  • Availability & Quotation: The Booker checks the Talent's availability and provides the Client with a quotation outlining the fees, expenses, and other terms.
  • Negotiation: The Client and Booker negotiate the terms of the engagement, including fees, riders, and other requirements.
  • Confirmation: Once the terms are agreed upon, the Client confirms the booking and provides any required deposits or guarantees.
  • Invoice Execution: Both parties receive and confirm receipt of a legally binding invoice which acts as a contract outlining all terms and conditions of the engagement. Confirmation of receipt also serves as agreement to invoice terms and conditions.
  • Performance & Payment: The Talent performs as agreed, and the Client fulfills payment obligations as per the invoice.
4. Payment Terms
  • Deposit: A deposit may be required to secure the booking, portions of the deposit or all of the deposit may be non-refundable if booking is canceled within a timeframe set by talent or outlined within invoice.
  • Payment Schedule: The invoice will specify the payment schedule, including any deposits or installments.
  • Methods of Payment: Acceptable methods of payment will be outlined on the invoice.
5. Booking Cancellation Policy

This Cancellation Policy outlines the procedures and consequences for cancelling bookings of artists, performers, or entertainers (collectively referred to as "Talent") by either the Client or the Talent.

  • Client Cancellation: The invoice will specify the cancellation policy, including any applicable fees or penalties for client-initiated cancellations. By default, any Client cancellations will result in forfeiture of the booking deposit.

    • Notice: The Client must provide written notice of cancellation to the Booker and the Talent in accordance with the invoice.
    • Cancellation Fees: The following cancellation fees may apply, based on the time of cancellation prior to the scheduled performance date:

      • 1 day or more 100% of the total booking deposit.
      • Day of: Cancellation fee which is 3% of the total booking fee.
    • Non-refundable Deposit: Any deposit paid to secure the booking is non-refundable unless there is a talent cancellation due to unforeseen circumstances.
    • Expenses: The Client may be responsible for reimbursing the Talent for any non-recoverable expenses incurred in connection with the cancelled engagement, such as travel and accommodation costs, as outlined in the invoice.
  • Talent Cancellation: In the event of Talent cancellation due to unforeseen circumstances the Client may be returned their deposit and any payments made towards the booking.

    • Notice: The Talent must provide written notice of cancellation to the Booker and/or Client as soon as possible.
    • Force Majeure: If the cancellation is due to Force Majeure, the Talent will not be liable to return the booking deposit or pay any cancellation fees.
    • Non-Force Majeure: If the cancellation is not due to Force Majeure, the Talent may be responsible for:

      • Securing a Replacement: Making reasonable efforts to secure a suitable replacement at no additional cost to the Client.
      • Reimbursing Expenses: Reimbursing the Client the booking deposit.
      • Leveraging Talent deposit: The Booker or Client can also make reasonable efforts to secure a suitable replacement through the Giggy platform with the existing booking deposit as a credit. Any new bookings made with a credit must be confirmed with the new Talent and processed with a new invoice.
  • Mitigation of Damages: Both the Client and the Talent have a duty to mitigate damages in the event of a cancellation. This means taking reasonable steps to minimize any losses incurred as a result of the cancellation.
6. Dispute Resolution

Any dispute arising from this Cancellation Policy will be resolved with mediation facilitated by Giggy Entertainment client services in accordance with the invoice provisions.
